Regarding SBA loans: what are the particularly underwriting criteria that makes loans more or less favorable?
D D
15:03
If we have existing SBA loans. Are we getting any break in terms of payments like delaying the payments by 3-6 months to help till the income levels get better
vishal sharma
15:16
Is there any information on the state is working with the insurance companies to either include or make exceptions to our ability to file claims for loss of revenues due to impact from virus pandemic?
Mark Haas
15:27
So my read of Family’s First is that we ultimately have to cover about 25% of an employee’s annual compensation under this bill with no clear expectation of income. It seems to me the most prudent action is to lay-off employees UNLESS government action is fast-tracked faster than the bill’s effective date. Looking back on the recession as an example of exigent circumstances – I can’t conceive how the government and or banks would be able to effect loans in less than two weeks. I am forced to make an impossible decision in days and the prudent course is to close and wait and see. Why would congress place such a tremendous burden on small business, no burden on large business without a roadmap to calm us business owners?
David Bokash
18:14
Sorry I will type it in Chat.
Sachin Rana

Adding to Mark's question, how do we take care of our fixed operating costs like rent and payroll when our revenue has dropped almost 90%

My question is in regards to the Disaster Loan Assistance program, I have started the online process, and the online loan application process has stalled on the Request for transcript of tax return. I have tried for several days to proceed past this step, is there a problem with the program

We just got a SBA 7a loan in February. Do we still qualify gor the SBA Disaster loan?
Nicholas Harvey
22:59
Carol, they apparently won't answer that here -- but probably yes.
Nicholas Harvey
23:10
It sounds like they don't know anything about the underwriting.
Nicholas Harvey
23:20
they = SBDC; SBDC is not the SBA.
Nicholas Harvey
23:35
SBDC is funded by SBA; and is a resource to small businesses.

I have a unique situation with my payroll company and EDD which effects my staff's ability to claim unemployment. Is there an SBDC Advisor that would be able to help me? Basically when I started with my payroll company, they completed my EDD paperwork incorrectly and the EDD assigned me an Exempt Status (number) and all 3 state taxes (employee and employer paid) were not taken from paychecks and submitted to the State for the past 2.5 YEARS. So we have not been contributing to the SUI. I don't know if my staff can apply for Unemployment.

Carol Fabretti
40:47
We are an employer with under 50 employees. Are we required to provide "paid" family leave despite the fact that our business is closed now. We can't make it
Mark Haas
40:54
a lot of business interruption insurance has an exclusion for communicable diseases - Spanish Flu era - you need to check the fine print
Maggie
41:07
Does the Families First Coronavirus Act that was passed last night apply to employees who are off work due to the County’s shelter in place order? (The new law allows/requires businesses to provide two weeks of paid sick leave to employees, which will supposedly be reimbursed to the business via future payroll tax credits.)
Mark Haas

All employers under 500 EE's are now required to pay both 80 hours sick leave and 12 weeks Emergency FMLA benefits

46:03
yes
Thirsty Bay
47:10
if the business has been established less than 1.5 years, does it still qualify for the disaster relief funds?
D D
47:17
Insurance companies are saying that they are not covering since virus disaster is not included in the coverage
Bob Komoto
47:27
The exact answer is that the SBA is allowing an 11 month deferral for the first payment - so 1 year before you start paying.

Things are changing as much as several times a day. The functional part of this Reference Guide is that it identifies and consolidates information at this moment. The trick is to find the information you are looking for in the guide and then go back to the original SBA.gov, EDD sites for any updates. Just finding this stuff is scary.
Aleks Aris
52:38
@ Anurandha & Vishal, actually the rate is 3.75% for businesses and 2.75% for nonprofits, see SBA's webpage at: https://www.sba.gov/about-sba/sba-newsroom/press-releases-media-advisories/sba-provide-disaster-assistance-loans-small-businesses-impacted-coronavirus-covid-19

It is an amazing experience and maybe of our clients do it to destress. I have been in contact with William, the General Manager, of the Safe Harbor in Emeryville. He has told me that The County has closed the marina until further notice. I can not operate without access to the water. As a funded startup, if you have had and continue to face ongoing expenses like rent, utilities, etc those can go into the debt and asset section to help establish how much injury is occurring.

Is there any discussion within the government to protect small businesses from landlords. One of the largest risks to our business is the rent obligations, especially if this lasts for a number of months. Small businesses taking on dept to in turn pay the property owners seems like we are bearing the worst part of the burden.
Aleks Aris
01:28:43
@Preet, as I recall from the morning videoconference, it is from 2-3 weeks to 4-5 weeks and then once there is a request to submit further documentation, once those are submitted, 5 business days. And this is as of this morning and this timeline might change.

I have been hiring and interviewing candidates until this Family First Bill - I was not afraid at all. The fact that the government has mandated payments without recourse is forcing to make business decisions - not emotional decisions. As het fiduciary I have an obligation to protect the business. Given that there is doubt and uncertainty - I have to protect our corporate resources until th epath is clear.
Bob Komoto
01:29:40
Dave, the SBA does not count “potential revenues” as part of your economic injury but your employees, rents, and other ongoing expenses are part of your Debt and Asset section that is used in part to determine injury.

Mark Haas
01:38:12
3 days plus 80 hours - you cant use existing benefits in lieu of the new 80 hours it is an incremental burden effective May 2nd. Any employee on payroll part-time or full-time will be given 80 hours of sick time and Shelter in place qualifies for sick time

Carol Fabretti
01:41:28

Mark Haas
01:41:33
the EFMLA is equally burdensome requiring a minimum of 2/3 pay for 12 weeks (14 days unpaid) for care of a family member including care of minors home from school due to closure

Our business relies on hourly employees and independent contractors, who may not qualify for unemployment with reduced hours, etc.? Can you give any resources and advice?
Scott Varney
01:49:52
Here’s a list of stuff to have ready when you do an application for the disaster loan: electronic/downloaded copy of your last 3 years of tax returns to upload. If you own stocks, have purchase price and date along with current value. If you have a cash value life insurance policy, what is the current cash value? Debts: have all of them ready (debt amount and monthly payments). Mortgage: have all mortgage info available; amount, payment, lender with their address. If you have a tax lien, have info available. All sources of income available. Lastly, it is great to have a scanner available. It’s easiest if you can print the Request for Transcript of Tax Returns form, sign it, and upload it immediately. Having this stuff ready will help with time to do the application.

@Sheena, probably it will be posted on the following location. Go to ACSBDC website: https://www.acsbdc.org/ Then click "LEARN MORE" next to "COVID-19 SMALL BUSINESS RESOURCES" on the banner, which will take you to: https://www.acsbdc.org/covid-19 Then, scroll down to see the button "Watch the FREE Webinars", click that and you shall have the page where the earlier webinar was posted there.

Does anyone know how long is the State Shelter in Place ordinance?
Scott Varney

Shelter in Place can make doing errands a misdemeanor if it does not fit the exemptions. At least that’s what I read last night.

Speaking of Grants - popular topic BUT since you can pay back the loan over 20-30 years its almost like having a grant you don’t pay back
